Right to change and modify Our Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms or place them clearly on documentation related to the course or service. Your continued use of the Website or our service(s) after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Please do read these carefully as being a very small company we stick to these booking conditions rigidly , they are not just 'small print’
Open Studio Sale Terms and Conditions of Sale
Returns
Work is sold as seen and not returnable. We make no guarantees as to the finish and condition of any work upon receipt (see Quality and finish as well as Delivery below), and strongly recommend that buyers view and collect open studio teaching studies from the studio in person.
Work Quality and finish.
Buyers note that the works are not intended as gallery quality. Works offered for sale are teaching studies and may be unfinished (as depicted in sales brochures) painted over existing works, on reconditioned supports or have some scuffing or other wear and tear from being used and stored in a working studio environment.
Framing and Fixings
Works are offered at a competitive price as is from the teaching studio, i.e., unframed and without fixings. We will not remove any extant fixings that may be on reconditioned supports.
Delivery
Work is priced competitively with studio collection in mind. Mail order of works is at the buyer’s risk and cost. We cannot be held responsible for damage in transit whether the works are picked up by the buyer or a courier service. We strongly recommend that buyers pick up works in person as board edges and stretched canvas is frequently damaged in transit. We will despatch work well wrapped in bubble wrap and similar protective packaging.
Summer School Terms and Conditions
Covid -19.
We will implement any guidelines in force in respect of COVID19 at the time of your course, and these will take precedence over our general terms and conditions, as well as modify aspects of the course program, content or schedule in making Norfolk Painting School Live Ltd a Covid secure space within which to work for both our staff and our clients.
We reserve the right to ask any client to leave the school premises immediately and without any compensation should they flout any Covid-19 guidance from PHE or the Government in force at the time of the course.
All bookings after March 2020 , are strictly non refundable if we have to cancel or postpone your booking due to PHE or Govt guidance relating to Covid-19, however you will be able to transfer your booking to an alternative course date, or an alternative course (should your first choice not be available), within 6 months after your original course start date, subject to a course being available, or use your course fee towards online tuition.

In the event of your alternative course choice having a higher fee than your carried forward balance, you will need to pay the difference to confirm your new booking.

If you are unable to attend any alternative course or course dates we can offer, then your course fee will be forfeited in full.

Places are strictly limited and are sold on a first come first served basis, we are sorry that places cannot be reserved without payment.

The course fee is charged in full at the time of booking, and is strictly non-refundable, after your statutory 14 day cooling off period.
General Terms & Conditions

We reserve the right to cancel any course at any time. If we need to cancel a course we will refund in full any course fee received for that course.

We will not be responsible for any advance costs you may have incurred e.g. travel or accommodation.

We reserve the right to substitute the published tutor with no notice.

We strongly recommend that you take out appropriate travel insurance to cover your course fee in the event that you cannot make your course. For example weather, illness, family bereavement

Course fees do not include lunch, accommodation or transfers to / from the School.

Students are strictly forbidden to use cameras or use camera functions on mobile devices in the studio. If this condition is breached you will be required to allow staff to erase images from the device.

Students must not bring any items of special value onto the school's premises. The school will not accept responsibility for the loss of any persona possessions.

The school will not be liable for any loss suffered by you resulting from any event which is beyond the reasonable control of the school. e.g train strikes.

We may take photos during the course to use on social media or our website , if you would prefer to be excluded from any photo please let us know at the start of your course otherwise permission will be deemed to have been given.

It is your responsibility to be punctual to any class , we will not be responsible for any content missed due to late arrival.
Force Majeure
Please note that Norfolk Painting School Live Ltd can’t accept liability , pay compensation or refund where the performance or fulfilment of our contractual obligations is prevented or affected by reason of circumstances amounting to a ‘force majeure’.Circumstances amounting to a ‘force majeure’ includes any event which we or the supplier of the service(s) in question could not, even if all due care was taken, foresee or avoid and which are beyond our control.

We accept all major credit and debit cards, (except Amex)
WHAT THE COURSE INCLUDES
Courses include mediums, low odour solvents for use on the course, printed references, and one pre - prepared support plus use of an easel and a palette for and on the lessons.
You are welcome to keep any work you originate at the School, and should plan to transport one painting home varying in size from 20' x 24' up to 30" x 20", you should bring old newspapers or something similar to protect your car. We are unable to ship your painting.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Norfolk Painting School Live Ltd, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Norfolk Painting School Live Ltd assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Indemnification
You agree to indemnify and hold Norfolk Painting School Live Ltd harmless from any demands, loss, liability, claims or expenses (including legal fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website
Right to Suspend or Cancel User Account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time, subject to our statutory obligations in respect of refunds under UK law for accessed or received online and streaming services . Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment
Purchasing our products and Services
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
Sales of tickets to Masterclasses, and other online courses or events with limited capacity are non refundable and non transferable (subject to your statutory rights under UK law)
The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.
Force Majeure
.1 Neither party is responsible for any failure to perform its obligations under this contract, if it is prevented or delayed in performing those obligations by an event of force majeure.
.2 Where there is an event of force majeure, the party prevented from or delayed in performing its obligations under this contract must immediately notify the other party giving full particulars of the event of force majeure and the reasons for the event of force majeure preventing that party from, or delaying that party in performing its obligations under this contract and that party must use its reasonable efforts to mitigate the effect of the event of force majeure upon its or their performance of the contract and to fulfil its or their obligations under the contract.
.3 Upon completion of the event of force majeure the party affected must as soon as reasonably practicable recommence the performance of its obligations under this contract. Where the party affected is the contractor, the contractor must provide a revised programme rescheduling the works to minimise the effects of the prevention or delay caused by the event of force majeure.
.4 An event of force majeure does not relieve a party from liability for an obligation which arose before the occurrence of that event, nor does that event affect the obligation to pay money in a timely manner which matured prior to the occurrence of that event.
.5 The contractor has no entitlement and the project company has no liability for:
(a) any costs, losses, expenses, damages or the payment of any part of the contract price during an event of force majeure; and
(b) any delay costs in any way incurred by the contractor due to an event of force majeure."
Our Services

Norfolk Painting School Live Ltd supplies online painting demonstrations, tuition, Face to Face painting lessons and associated Member services.

All prices (where applicable) include VAT at the standard UK rate.
Access

We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.
Length of Contract

Your contract will run from and for the dates shown in your booking confirmation, all access and services both current and historical will cease immediately at the end of your contract.
